Characteristics and particulars of the locus standi in the legal proceedings against the resolution of the General Meetings of Shareholders

Summary/Abstract: The active procedural quality coincides to the point of overlapping with the interest of the shareholder, in the sense that there is no need to prove the concrete interest of the shareholder, but it is presumed to exist. So, we are in front of a study that aims to present the practical manifestations of how to involve partners in the life of society by participating in its general meeting or, conversely, by not participating in the meeting, which has repercussions on the imputability of decisions.
