Summary/Abstract: The commented judgment of the Supreme Administrative Court concerns the issue of limitation of continuous or repeated irregularities. Doubts have arisen in domestic practice as to the significance of a continuous irregularity under Article 3 (1) of Council Regulation (EC, Euratom) No. 2988/95 of 18 December 1995 on the protection of the European Communities financial interests. The interpretation of this concept is important for the correct determination of the beginning of the limitation period for irregularities resulting from contracts concluded in violation of the provisions of the public procurement law. As part of this commentary, the author partially criticized the position of the Supreme Administrative Court, and at the same time presented the correct interpretation of EU regulations in the field of the statute of limitations for this type of irregularities.
