Limitation of Irregularities in Projects Co-financed by EU Funds. Gloss to the Judgement of the Supreme Administrative Court of 18 May 2017 (II GSK 4503/10)

Summary/Abstract: The commented judgement of the Supreme Administrative Court concerns the issue of limitation of irregularities in EU projects. Despite the application of EU Regulation No. 2988/95, uncertainty appeared in Polish practice as to the length of the limitation period and the rules for determining the beginning and end of this period. As part of this gloss, the author critically referred to the position of the Supreme Administrative Court, and at the same time presented the correct way of interpreting EU and national provisions regarding the limitation period of irregularities.
