Summary/Abstract: An important role in digitalised economies is played by online platforms.It needs to be examined to what extent the legislation on safety and health at work is applicable to the activity carried out on a digital platform and how we treat in this case the concept of ‚employee’, ‚employer’ and ‚self-employed person’. Is the digital platform worker a self-employed or an employed, the worker’s activity on the digital platform can be defined as an employment relationship or is it merely a service activity subject to civil law rules?So far as persons working through the work platforms are regarded as self-employed persons, they do not have access to the minimum labour and social protection rights, which apply to workers in all Member States, being exposed to inadequate working conditions (right to a minimum wage, regulations on working time, safety and health at work, social security entitlements).
