Compensatory mechanisms for protection in case of non-compliance with the requirement of a reasonable time for deciding of criminal cases

Summary/Abstract: The present paper examines the legislative changes made to the Judiciary System Act and the State and Municipal Liability for Damages Act in connection with the introduction of adequate compensatory mechanisms for defence in case of non-compliance with the requirement to consider criminal cases within a reasonable time. Besides analyzing the nature of the regulation and its weaknesses, suggestions have been made in order to defend better the right to hear and decide cases within a reasonable, as well as some of the main reasons leading to its violation have been indicated.
