Summary/Abstract: The matter of probation has been the subject of numerous decisions of the Constitutional Court, the most relevant being those concerning the technical measures of surveillance. The legal battle focused in particular on the interceptions already carried out at the time at the pronouncement of the decisions and respectively the effect of these decisions regarding the aforementioned interceptions. Court’s assessment regarding the effect of its decisions on the interceptions already carried out is bizarre because it violates precisely the provisions of art. 147 para. (4) from Constitution.
