Summary/Abstract: The new Code of Criminal Procedure reshaped the role of the prosecutor in criminal proceedings. The prosecutor’s role, consisting in investigating and supervising the criminal investigations carried out by the judiciary police, during the phase of Criminal Prosecution, was broadly maintained, except for some functions that were either restricted, modified or enlarged. During the Judgement Phase, the prosecution function has been strengthened, since the presence of the prosecutor during the criminal proceedings became, in principle, mandatory. The article attempts to identify the main differences regarding the role of the prosecutor in criminal proceedings, as governed by the old and the new Code of Criminal Procedure.
