LEGAL NATURE OF THE DECISION OF THE COUNCIL OF MINISTERS FOR THE ADOPTION OF MANAGEMENT PLANS FOR PROTECTED NATURAL AREAS

Summary/Abstract: This article examines the legal nature of one of the acts adopted by the Council of Ministers for environmental protection, namely the decision on the adoption of a management plan for protected natural areas. The legal definition of "protected area" from the Convention on Biological Diversity is derived and discussed. After a review of the case law and literature in this area, two more common views are highlighted. According to the first, advocated by the highest administrative judges, it is a general administrative act and the second, which is put forward in the literature, is that these are sub-regulatory administrative acts. The second view is advocated based on the characteristics of regulatory administrative acts.
