Summary/Abstract: In the member states of the European Union where telework was successfully implemented before the pandemic, policies were adopted to balance teleworkers' work and rest time by guaranteeing the teleworkers' right to disconnect. In Romania, the right to disconnection is not provided by the legislation in force, and even if there is a strict formal delimitation between working time and rest time, in practice, however, this delimitation is rarely respected. The recognition of the employee's right to disconnect by adopting legal provisions must be equally applicable to all workers, regardless of their professional status, sector of activity, work location, position and responsibilities, etc.
