Summary/Abstract: The commentary provides an analysis of the judgment of the Court of Justice of the European Union on 16 February 2022 in Case C-157/21. The judgment represents the first statement of the CJEU on the rules of application of the so-called conditionality mechanism, which was established by Regulation (EU, Euratom) 2020/2092 of the European Parliament and of the Council of 16 December 2020 on a general regime of conditionality for the protection of the Union budget. In the judgment under review, the CJEU formulated several important guidelines explaining in detail the personal and material aspects of the application of the Conditionality Regulation, taking into account two key objectives: the protection of the Union budget and the strengthening of the rule of law in the sovereign Member States of the European Union.
