Procedural aspects related to the creditor’s intervention during the enforcement started by another creditor

Summary/Abstract: The new Code of civil procedure offers a modern and anchored in the novelties imposed by the socio-economical realities civil procedural regulation. In relation to enforcement, among the proposed solutions it’s also included the thirdparty creditor intervention procedure, in the enforcement phase, procedure that is shared between the bailiff and the executing court. The analysis of the applicable procedural rules, through the eyes of novelty and pursued objective, may be of interest, at both doctrinal and jurisprudential level.
