Summary/Abstract: Murder per se is not a crime, nor is it a tort. Whoever assists or induces another to commit suicide commits a crime. The act may not be a crime, but a tort, if it amounts to physical assault or mental harassment of a person that prompts him to take the last measure of ending his life. The article investigates the specifics of this hypothesis, which cannot be qualified as a crime within the meaning of Art. 127 of the Penal Code, but is a delict against the person who commits suicide or attempts suicide. Special attention is paid to the tort related to suicide, which takes place the signs of domestic violence, because in practice these are the most common cases.
