Summary/Abstract: Analysis of the preparation of a draft law from the point of view of the classification of formal and substantive laws and their subsequent enactment. The latter is a test of the concept of the rule of law. The deteriorated quality in the motivation of draft laws is due to a deficit in comprehensively reflecting the actual rationale, the meaning of the establishment and maintenance of one or another legal position, as well as guarantees for the results of its subsequent change or cancellation. The direct result of this is related to the question of the guarantee of subjective rights and the ineffectiveness of the legislator when he is faced with the choice of whose rights to protect – the state or an individual subject.
