The Court Rather Would not See the Plays. On the Search for the Optimal Unit of Analysis

Summary/Abstract: The text is a contribution to the symposium on the book Citační analýza judikatury. The author addresses the question whether more interesting results could not have been achieved by choosing a different unit of analysis. That is, whether, in empirically examining the case law, it might not be more interesting to look primarily at the “lower levels” (i. e. individual judges or judicial panels) than at the courts or even the judiciary as a whole. The following text presents several possible strategies that may yield interesting findings about the Czech Constitutional Court and its inner workings.
