Partitipation of Associations in Administrative Proceedings

Summary/Abstract: The new Civil Code has brought many changes also in to the administrative law. Among others, there was a significant change in the freedom of association. For many years there were simple civic associations, which fulfilled a variety of functions, e.g. the protection of nature and landscape and through which citizens could participate in environmental decision-making processes. Since 2014 the civic associations have been replaced by another type of associations (societies). A related issue is whether rules which were applied to civil associations in the field of environmental protection can be used also for societies, in particular whether unchanged article 70 of the Act on the protection of nature and landscape can be used. This article claims, that the answer is positive, i. e. the new subjects can participate in environmental procedures in the same way as civic associations did.
