Summary/Abstract: Judicial review of land use plans can have many significant impacts. Among other things, it can seriously affect the planned construction. In some cases the investor loses the opportunity to realize his building plan and may lose millions of crowns. This paper deals with the issue of compensation for the damages caused by cancellation of the land use plan. We can ask a few questions: Can the canceling of an illegal land use plan bring about any damages to the investor? Are the government or public authorities responsible for this damage or is it a part of business risk?
