Controversies related to the determination by the Polish Financial Supervision authority of the rules for calculating the amount of compensation under the compulsory motor third party liability insurance

Summary/Abstract: The article concerns the controversies related to the determination by the Polish Financial Supervision Authority in its recommendations of the rules for determining the amount of com- pensation paid by insurers under the compulsory motor third party liability insurance. The article describes doubts regarding the competence of the supervisory authority in the field of making a binding interpretation of civil law. Problems related to the rules of determining the local car ser- vice market, the rules of reimbursement of replacement vehicle rental costs, the rules of taking into account discounts on spare parts and the rules of concluding settlements between the insurer and the injured party were described in detail.
