AMENDMENT OF ART. 258 OF THE PENAL CODE IN THE LIGHT THE DYNAMICS OF ORGANIZED CRIME

Summary/Abstract: The aim of the article is to present the amended criminal law methods in the subject of Art.258 dealing with the organized group and and criminal association. The background of theseconsiderations is a statistical analysis of the phenomenon of organized crime in three basic areas of itsactivities: criminal, economic and drug-related. Moreover, statistics of the total number of criminalgroups eliminated in recent years will be presented. An important cognitive element is also the indicationof the importance of the phenomenon, primarily in terms of the damage generated to the State Treasury.Moreover, the author points to current substantive legal solutions regarding the implementation ofeffective mechanisms to combat organized crime. In this respect, the author attempts to determine thevalidity of amending the provision of Art. 258. Given the above, the main research aim is to diagnosewhether the dynamics of organized crime will change in the light of the ongoing criminal law changes.
