Summary/Abstract: The administrative contract represents a modern form of administrative action that meets the needs of the public interest. In comparative law, it enjoys the reputation of an institute that solves administrative problems that, among other things, are reflected in the lack of financial, personnel and professional resources for the performance of current administrative tasks. However, its role is not precisely defined even today. In this profiling, this institute faced many objections that have not been ignored to this day. In comparative law, there is no agreement on the constitutive elements of this legal institute. Therefore, this paper points out some problems that arise in French law during its recognition.
