On the legal nature of the Engineer's decision issued in connection with the execution of administrative contracts concluded on the basis of the FIDIC model

Summary/Abstract: Starting from the domestic case-law regarding the legal nature of the FIDIC Engineer’s determination issued with respect to the performance of roads infrastructure contracts, the author lies out the reasons for which the Engineer’s determination cannot be qualified as an administrative act and subsequently explores alternative venues of interpretation in order to identify the correct legal nature of the Engineer’s determination.
