ANOTHER GROUND FOR REVIEW IN CIVIL PROCEEDINGS

Summary/Abstract: In the article, research of judicial practice was carried out and the procedural-civil norms regarding one of the grounds for reviewing court decisions, because of the reason finding some civil cases pending in the courts. The important scientific problem lies in the scientific substantiation of the practical application of the legal provisions, the final and irrevocable decision pronounced on the same issue, in similar procedures, can be considered as the essential circumstance or fact, grounds for review, which is not currently expressly provided for in art. 449 CPC RM, as well as the analysis of the legislation, resulting in the substantiation of rigorous proposals in order to improve the legislation and jurisprudence. Through this study, we want to provoke further analysis and discussion on the respective topic.
