The fideicommissary substitution – from the protection of the nobility to the conciliation of some family relations

Summary/Abstract: The present study aims to analyze the evolution of fideicomission substitution and the role it has had over the centuries. The winding route taken by this institution can rightly be considered a real odyssey. Prohibited for almost a century and a half, fideicommissary substitution is reborn under a different architecture and with a regulation adapted to the new social realities, but also with a well-defined purpose: the reconciliation of certain family relationships. The present study brings before the reader less discussed aspects, but of great relevance regarding the implications of fideicomission substitutions within family law relationships.
