Municipal public library as an administrative entity

Summary/Abstract: The purpose of this article was to review the doctrinal statements on the administrative establishment and attempt to evaluate the municipal public library through the lens of the theory of the public establishment developed in administrative law. The research results in this work proved that this entity has all the characteristics of an administrative establishment. Accordingly, the library cannot be categorized as a state or local government body, and it has been shown that these entities are equipped with a personal and mate-rial substrate, carry out tasks of providing administration, exercise establishment authority, and have the power to establish administrative-legal relations. The analysis of the problem was carried out primarily based on Polish laws that contain regulations on the status of libraries, as well as case law and doctrine.
