The Revocation of a Donation Due To a Refusal to Provide Maintenance in the Case of Competing Rights of Maintenance

Summary/Abstract: The revocation of a donation due to the refusal of the donee to provide the donor with the maintenance the latter needs is a matter on which abundant judicial practice has been accumulated and there are a few substantial legal studies. However, the issue of the competing rights of the donor, when they can seek maintenance from more than one person on different legal grounds, has not been much attended to. This article aims at filling this gap. In the course of the exposition other matters, which are important for the revocation of the donation and the obligations of the donee, are also discussed, because they are either controversially solved by the courts, or the constant (or predominant) judicial practice is questionable or at least should be critically reviewed.
