Summary/Abstract: The initiation of the criminal process incites divergent interests that must be reconciled. On the one hand, for the accused, his life, freedom and reputation are at stake, so that the necessary means for the effective exercise of the right to defense must be recognized in his favor. The victim, already harmed by the commission of the criminal act, is directly interested in avoiding repeated or secondary victimization, so the criminal policy of the state and subsequently, the judicial bodies must be oriented towards the adoption of effective measures in this regard.Finally, reconciling the accused's right to defense with the victim's right not to be subjected to repeated or secondary victimization can be problematic in practice.
