On the Right to Legal Counsel as a Fundamental and Complex Subjective Right

Summary/Abstract: This article considers the right to legal counsel a fundamental and complex subjective right, exercised through a system of legal relations. There are some serious problems identified in legislation and in the case law of the courts, which disrupt their optimal implementation instead of supporting them. A de lege ferenda proposal has been made to solve some of these problems.
