Some considerations on the crime of child pornography, provided by art. 374 para. (11) of the Criminal Code

Summary/Abstract: The crime of child pornography, according to our law, generates real controversies regarding, among other things, the legal object, the compliant transposition of supranational rules, respecting the lex certa principle in some normative hypotheses, but also the connection with other crimes. The alternative of the offense covered by this analysis is no exception and thus some clarifications are required regarding its constitutive content and the connection with other crimes.
