Summary/Abstract: The Court notes that the European court emphasized that an analysis of the economic and legal ties between the allegedly related companies takes place only if they cannot be formally deduced from the relationships listed by the legislator in art. 3 paragraph (3) from the annex to the Recommendation on SMEs, a situation that is also encountered in the present case.
