Summary/Abstract: The inviolability of private life is included among the principles of the criminal process and is a right guaranteed by both international and domestic acts. These legislative acts do not allow interference in private and family life by state bodies. However, this right is not an absolute one and, respectively, its coercion can only take place in legal, public utility and according to proportional grounds and purposes. The respective article comes to analyze the national and international jurisprudence that guarantees the inviolability of private life and, at the same time, to identify the legislative and practical deficiencies in the application, assurance and guarantee of this right, finally coming up with rigorous proposals for the protection of the rights of participants in the criminal process.
