Regulations introduced by the amendment to the Electoral Code of January 2023 regarding the possibility of recording the activities of district electoral commission versus the secrecy of voting

Summary/Abstract: The aim of the article is to emphasize the connection between the regulations introduced by the amendment to the Electoral Code of January 2023 and the secrecy of voting. The paper presents the thesis that amended regulations may lead to a violation of this principle. In order to determine the potential risks Polish jurisprudence, the Venice Commission and the constitutionalists’ position were compared with the new wording of Article 42 of the Electoral Code. Reference is also made to previous provisions regulating similar issues and the opinions of state authorities. The analysis confirmed that the new rules may violate the secrecy of voting. The findings made in the article are important considering the upcoming elections in 2024 and the importance of the discussed principle in electoral system.
