Summary/Abstract: The article addresses the issue of understanding the premise of illegality in the tort liability regime as relative illegality. It is an analysis of the doctrine and case law. The aim is to answer the question whether adopting the concept of relative unlawfulness is an appropriate tool for narrowing the scope of liability for damages, and whether understanding the premise of unlawfulness as a relative phenomenon is an appropriate way of interpreting the provisions of the Polish Civil Code. The author claims that use of mechanisms narrow- ing the scope of tort liability is necessary due to the increasing number of phenomena that may cause mass formulation of claims for damages.
