Summary/Abstract: Artistic creation has accompanied people since the beginning of human history. The ancestors of modern people were undertaking this activity most often in terms of social or religious life, as well as describing everyday life. Art is considered a basic component of the culture, expressed by the manifestation of human creative abilities. In the past art was considered to have great importance in shaping social attitudes, often based on religious values. Nowadays art often arouses controversy and goes back to difficult and pinching topics. One of the taboo topics in art is the area that touches on sexuality and carnality. Artists often face accusations that their work is pornographic and not artistic. The freedom of artistic expression is subject to many legal restrictions resulting from international standards and national regulations.They make it possible to judge from the legal point of view what nature a given art product has. At the same time, the doctrine wonders whether such action does not kill artistic creativity, or at least does not significantly limit it. This study attempts to find the limits of shamelessness in art on the examples of photography, exhibitions, performances, painting and film, and to ascertain that art deserves the highest protection if it is accompanied by the right intentions of the creator.
