Practical problems in the application of the new Art. 343B, para. 6 of Penal Code

Summary/Abstract: In 2023, one of the successive amendments to the Criminal Code was implemented, as in Art. 343b of the Civil Code, a new paragraph was added. 6, which provides for the possibility of seeking criminal liability in cases where the perpetrator refuses to be checked according to the proper procedure to establish the use of alcohol and/or narcotic substances, after he has been punished for the same act by administrative order. This article will examine some practical problems that would arise in connection with the enforcement of the new text of the law.
