Summary/Abstract: Acts preceding the actual perpetration of the crime are traditionally referred to preparation and attempt. The Polish Criminal Code does not explicitly determine which crimes can be attempted. The statutory description of some types of crime is formulated like an attempt (e.g. Art. 128 CrC) or like a preparation for another specific crime (e.g. Art. 200a CrC). The problem considered in this study is whether criminal preparation can take the form of an attempt to realize this phase of the crime or whether it will be punishable to attempt to commit a crime whose statutory description is formulated like an attempt.
