Summary/Abstract: In its 50 years of existence (1959-2009), the Strasbourg Court has become the main efficient European instrument for the protection of fundamental rights and freedoms, its decisions producing major effects in the democratic architecture of our continent, as well as a thesaurus of case law substantially guiding all the judges in Europe’s States. On the occasion of this anniversary, I believe a retrospection of the Court’s evolution in its 50 years of existence would be appropriate, and in particular a synthesis of the trends, constants and interpretations created by the Court, as well as the solutions of principle in the judgments against Romania, which could represent a minimum guideline for human rights professionals, as well as for the relevant authorities and all the persons interested. We believe this evaluation could be useful to our doctrine and case law but, in particular, to those in charge with the improvement and modernization of the Romanian judicial system.
