Summary/Abstract: Even so in practice they use this procedure little the government inspectors can grab the judge in chambers to see compelling an employer to set up measurements intended to assure hygiene and to ensure the security of the wage earners. So that these measurements are touchy of effectiveness the judge can match them of a periodic penalty payment and in certain conditions to liquidate it himself. So that it is efficient the judge will have to employ the fullness of the powers which are granted. During the liquidation of the final periodic penalty payment the judge will be able to modulate it to fix it to a sum taking into account the behaviour of the one to whom been addressed. The periodic penalty payment will be able to be possibly liquidated supplemented by a final periodic penalty payment fixed to the upper rate in that of the first one. The present decision is an illustration.
