Summary/Abstract: Respecting one's needs and specific conditions and circumstances which one could experience in life, the Islamic shari'a-lawyers have, on the basis of texts of Qur'an and Sunnah, done the appropriate rules about shari'a-legal privileges. This work shows how principle of darura and related fiqh rules which are the components of the established shar'ia-legal privileges institution, are being used as one of important props on which the contemporary Islamic lawyers and collective bodies for the issuing of fatwas and especially the European council for fatwas and research, base the legal solutions for actual problems of Muslims. Some of these legal solutions have been intended for the Muslim minority in the West, what is visible on the example of interest bank credits fatwas, insurance and the way of acquiring the life resources. However, there exist some general problems which concern the ummah as a whole and demand extenuating regulations based on the concept of darura. The light is shed on these problems through the analysis of fatwas about the transplantation of human organs.
