TERMINATION OF THE TRAVEL PACKAGE CONTRACT BEFORE STARTING THE EXECUTION OF THE PACKAGE

Summary/Abstract: The effects of the COVID-19 Pandemic had a major effect on the contracts concluded between tourists and travel agencies and, not infrequently, led to their termination, with the consequence of the obligation of travel agencies to refund to tourists all the amounts they paid based on the terminated contract. However, a large part of the tourists did not know that in such situations they have the legal right to terminate the contract and request the return of all sums and thus, succumbed to the pressures of the travel agencies and accepted the modification of the contracts or the "transformation" of the money paid in vouchers that they could only use by purchasing tourist services also from the respective travel agency's offer. Through this paper, we want to make a brief presentation of the situations in which the termination of such a contract can occur before the start of its execution, and the legal effects generated in each situation analyzed, in the hope that it can become a source of information for those interested.
