LEGAL CHARACTERISTICS OF THE CONTRACT OF PERSONAL GUARANTEE

Summary/Abstract: Although suretyship as a guaranteed mechanism is not a new institution and is used in the civil and commercial circuit with considerable intensity since the emergence of the law, it does not enjoy much attention from a doctrinal point of view. Suretyship as a legal institution is treated marginally in the specialized literature on the occasion of some analyzes of the theory of obligations or the ways of guaranteeing obligations. In domestic law, at present, we could identify only one important work dedicated to the suretyship. Through this work, we want to make a brief presentation of the legal characteristics of the suretyship, without claiming to consider this work as having an exhaustive character.
