Summary/Abstract: The availability of sufficient resources is still an important criterion on the free movement and the right of residence of European citizens in another Member State. Union citizens and their family members have the right of residence as long as they do not become an unreasonable burden on the social assistance system of the host Member State. This criterion takes a more important value in the context of family reunification, a right that can be exercised by EU citizens as well as non-EU citizens. The purpose of this study is to prove that the criterion of sufficient resources for community citizens is considerably diminished in recent years, by the implementation in all Member States of the 2004/38/EC directive on the right of free movement within the territory of the Member States. Otherwise, the sufficient resources are considered a necessary criterion for the family reunification of non-EU citizens, regulated in the European Union by the 2003/86/EC directive on family reunification.
