Summary/Abstract: In this paper the author makes an analysis of the regulation of the protection of witnesses and injured persons at the level of the European Union and the Council of Europe, briefly presenting the most important resolutions and recommendations adopted by the above-mentioned institutions. A significant part of the paper is devoted to the criticism of the position adopted by the European Union and the Council of Europe not to regulate the matter of witness protection by legal rules binding on the Contracting States. The author notes that, unlike in the matter of witness protection, in the matter of the protection of the injured person at EU level, framework decisions and directives have been adopted which are binding on the Contracting States.
