The educational aspect of the individual-preventive directive of judicial sentencing after the amendment of july 7, 2022

Summary/Abstract: The Act of July 7, 2022, amending the Criminal Code and certain other acts, modified the content of Article 53 § 1of the Criminal Code for the first time since the enactment of the Criminal Code, among other things, depriving the individual prevention directive of its educational character. This change contradicts both the modern axiology of criminal law and values of acon-stitutional nature and the universal principles of Latin civilization derived from Greek philosophy, Roman law and Christian morality. Therefore, it is proposed to interpret the indicated provision in such away that, through pro-constitutional interpretation and inferences based on the instrumental result of legal norms, it is possible to keep the educational aspect of individual prevention on an equal footing with other aspects.
