Summary/Abstract: The concept of “extended suicide” emphasizes the perpetrator’s suicide, disregarding the perspective of the injured party, downplaying his real harm, to which, despite the name, he did not consent. Therefore, this concept should be replaced with the concept of homicide-suicide or post-aggression suicide. This work aims to indicate the criteria differentiating the terms “extended suicide”, “homicide-suicide”, and “post-aggression suicide”, as well as the criminal law assessment of the perpetrator’s behaviour in each case from each of the listed forms of the act. The subjective elements constituting the criteria differentiating the concept include the perpetrator’s mental attitude to the committed act together with the psychopathological background of the decision to kill another person and take his own life by the suicidal perpetrator. In the case of suicidal homicides, altruistic motivation predominates, and the act takes place during the process due to cognitive disorders (delusions) typical of depression. Post-aggressive suicides are characterized by a negative motivation (e.g. revenge) and the perpetrator’s decision is most often based on personality disorders or addiction. Among the objective elements of the criteria covering both concepts, the type of relationship between the perpetrator and the injured party should be considered. In the case of a suicidal homicide, they are usually described as correct or even very good, and the murder is not preceded by violence. In the case of post-aggression suicide, murder or another act of aggression often results from previously used and gradually escalated violence.
