Summary/Abstract: Article 22 of Romania's Constitution regulates the right to life and the right to physical and mental integrity. Medical personnel, having a noble profession, contribute to obeying these fundamental human rights but also to legal and ethical rules. The difference between them is that if the breach of ethical values jeopardizes the rights, this is regulated by legal rules. If a norm is violated, without being detrimental to a patient, medical disciplinary sanctions will be applied, but if the doctor's conduct induces damage to the patient, the medical malpractice tort will compensate for the wrongs and harms inflicted to him.
