Summary/Abstract: In Article 22 of Romania's Constitution regulates the right to life and right to physical and mental integrity. Medical personnel, having considered a noble profession, contribute to these fundamental human rights but also legal and ethical rules. The difference between them is that if the breach of ethical values is jeopardizing the right equipment, is regulated by legal rules. If you violate a legal norm but is not detrimental to patient medical disciplinary sanction, but that conduct medical situation resulting production losses on account of a patient, as occurs for malpractice tort liability.
