Litigation Over Changes of Agricultural Land Use as a Challenge for Spatial Planning in Rural Areas in Poland

Summary/Abstract: The aim of this article was to determine how court rulings on the changeof agricultural land use influenced the Polish spatial planning system from 2014 to2023. In order to achieve the aim of the article, a database of rulings from the websiteof the Supreme Administrative Court was analysed. This is a collection of all judgmentspublished by the Supreme Administrative Court and provincial administrative courts.The database was searched for rulings issued between 2014 and 2023, in which (taking intoaccount both the operative part of the ruling and the justification) the expression ‘changeof agricultural land use’ appears (with a variation of words). A total of 5.324 judgments wereextracted, from which, after a comprehensive analysis, 142 judgments directly concernings patial conflicts related to the change of agricultural land use were extracted. The researchshowed that most of the rulings confirm the impossibility of changing the use of agriculturalland. Most of the complainants are private entities, nevertheless there is a serious groupof public entity complainants. A significant proportion of complaints relate to local plansand zoning decisions.
