Summary/Abstract: The publication concerns the admissibility of statutory limitations on the right of defence of a defendant in criminal cases and the material scope of such limitations, with an analysis of regulations concerning special proceedings. The situation of the accused in preliminary injunction proceedings, accelerated proceedings and in proceedings on private prosecution has been analysed. Special proceedings are characterised by a certain degree of deformation and simplification of procedural rules, sometimes also those of a guarantee nature. The author poses the question of their compliance with the clause contained in Article 31(3) of the Constitution of the Republic of Poland.
