Summary/Abstract: The role of the National Forestry Authority – Romsilva also includes the right to defend and ensure the integrity of the forest fund owned by the state, respectively to promote any legal action to recover the assets of the State that are given to it for administration, respectively the forest lands. Thus, the defense and ensuring the integrity of the state owned land fund must be interpreted according to the special law in a broad sense, respectively in the sense that the above mentioned authority exercises, on behalf of the state, all the attributes of the right of ownership in relation to forest lands, including that of filing an action in claim. Given the provisions of art. 16 of Law no. 26/1996, it can be noted that the certified extracts of forestry facilities have the ability to prove the belonging of a land to the domain of public property of the state over which Romsilva has the right to administer.
