Inspection of the Environmental Protection Inspector in the field of waste management and ensuring ecological safety in the Polish legal system

Summary/Abstract: The authors indicate that, with the reasonable treatment of ecological safety as a priority of the activities of local government administration bodies, the legislator, by expanding control competences, omitted broader regulation of the process sphere of control. In their opinion, it would be justified to at least make an appropriate reference in the scope of inspections carried out by the Environmental Protection Inspection bodies to some procedural norms contained in the provisions of the Code of Administrative Procedure and to supplement the regulations on inspection proceedings. In the case of situations that directly threaten the natural environment, this would not pose a threat to the speed of action of control authorities, but would allow for the ordering of the relationship between the controller and the controlled entity and provide instruments for protecting the rights and interests, in particular of entrepreneurs.
