Summary/Abstract: This study starts from the observation that liberalism and democracy designates two distinct political philosophies, many times being into contradiction, and their joining was done just because the liberals wished to limit the political power in the name of the human rights. The contemporary welfare state, where we assist to an inflation of social rights and to an unlimited arrogation of powers by the political power represent one of the reasons why the contemporary democratic discourse is on a wrong way, a way where the interests of the society are bigger than the interests of the individual.
